I. General Terms and Conditions of Sale
1.1 These general terms and conditions of contracting, together with any specific terms and conditions that may be established, will expressly regulate the relationships arising between abril et nature, S.L., with registered office at Calle Palautordera, 26 - 08401, Granollers, Barcelona, telephone 93 540 50 58 and with C.I.F. B61795035 (hereinafter abril et nature) and third parties (hereinafter "Users") who use the Internet portal www.abriletnature.es (hereinafter the "Portal") or any of its subdomains, as well as with third parties who contract the products offered through it.
abril et nature reserves the right, at any time, to unilaterally modify, without prior notice, and at any time, the presentation and configuration of the Portal.
1.2 These General Conditions have been drawn up in accordance with the provisions of Law 7/1998 on General Conditions of Contracting, Royal Decree 1906/1999 which regulates telephone or electronic contracting with general conditions in development of article 5.3 of Law 7/1998, Law 26/1984 General for the Defense of Consumers and Users, Law 7/1996 on the Regulation of Retail Trade, Royal Decree-Law 14/1999 regulating Electronic Signatures and any other applicable legal provisions.
1.3 By using the abril et nature Portal, you acquire the status of User. Both visiting and using and/or purchasing any of the Portal's products imply your acceptance, as a User, without reservation, of each and every one of the General Conditions, as well as any Specific Conditions that may apply to the purchase.
1.4 abril et nature may, at any time and without prior notice, modify these General Conditions, by publishing said modifications on the Portal so that they can be known by the Users always before visiting the Portal or acquiring any goods offered on the Portal.
II. Products offered. Purchasing system
2.1 The products offered on the Portal, along with their features and prices, will appear on the screen.
Shipping costs to the User's address will also be displayed on the screen and will always be the responsibility of the buyer. These products will be available for sale while supplies last. The prices shown on the screen are in euros and include VAT and any other applicable taxes, except in the case of typographical errors or for residents of the Canary Islands registered as such in the system, for whom prices will be displayed without VAT.
Offers will be clearly indicated on screen. abril et nature reserves the right to decide, at any time, which products are included and offered to Users through the Portal. Thus, abril et nature may add new products to those included on the Portal at any time, it being understood, unless otherwise stated, that such new products will be governed by the General Terms and Conditions in force at that time.
Likewise, abril et nature reserves the right to discontinue providing access, at any time and without prior notice, to any of the products offered on the Portal.
2.2. To purchase products offered on the Portal, abril et nature will request delivery and, where applicable, billing information from Users. This information will include name, full address, contact telephone number, email address, and delivery notes, and will be stored by abril et nature. abril et nature may use this information to contact Users who have made purchases, send offers, and provide other communications it deems appropriate.
Users can request to be removed from the mailing list by calling Customer Service at 93 540 21 85 or by emailing shop@abriletnature.es.
2.3 To place orders, abril et nature users must be at least eighteen (18) years old. The purchase process will be carried out through the electronic purchasing system, following the on-screen instructions. Users must add the desired product to their Shopping Cart, complete the order form provided, and submit it to abril et nature. This implies reading and accepting all of these General Terms and Conditions, as well as any applicable Special Terms and Conditions.
The purchase will be deemed to have been made at the address of abril et nature, located at Calle Palautordera, 26 - 08401, Granollers, Barcelona.
2.4 Once the purchase is complete, you will automatically receive an email confirming receipt of your order. This order confirmation from abril et nature is not a valid invoice or processing certificate, but only serves as proof of correct receipt. If abril et nature is unable to supply any of the requested products, the Customer Service department will contact you to discuss the best course of action.
III. Payment method, delivery and order cancellation
3.1 Payment for the price of the goods purchased and the shipping costs, which will appear on the screen, can be made by bank transfer or by credit card.
As an electronic payment system, abril et nature uses the Banco Sabadell and PayPal e-commerce payment gateways. All data provided for this purpose is encrypted using the SSL (Secure Socket Layers) protocol to ensure maximum security, and is never collected, stored, or viewed by any member of the abril et nature staff.
3.2 abril et nature undertakes to deliver the goods purchased by the User to the buyer's address indicated for this purpose on the order form (products will not be delivered to post office boxes or public access points), as soon as possible and, in any case, always within ten (10) calendar days from the date the order is placed. The shipping costs for the purchased items will be paid by the Buyer.
3.3. The Buyer will have fifteen (15) business days to cancel the purchase without penalty, provided the products have not been opened or used. Shipping and return costs will be borne by the Buyer, except if the cancellation is due to the receipt of damaged, broken, or deteriorated products, in which case abril et nature will cover the collection and reshipment costs.
The fifteen-day period established in the previous paragraph will be calculated from the date of receipt by the buyer of the purchased goods.
Order returns must be communicated in advance to the Customer Service department of abril et nature by calling 93 540 21 85. Once the buyer has exercised the right of withdrawal, and once the returned products have been received at abril et nature's facilities, the amounts received will be refunded by credit, excluding shipping costs if applicable, immediately and never in a period exceeding ten (10) days.
IV. Personal data protection policy
4.1 For the purposes of the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, abril et nature informs the User of the existence of an automated personal data file created with the data obtained on the Portal by and for abril et nature, and under its responsibility, for the purposes of information and marketing of the products offered on the Portal, as well as carrying out promotional and advertising activities that may be of interest to you, to expand and improve our Products by adapting our offers to your preferences or needs and to allow personalized browsing.
4.2 The user expressly accepts the inclusion of data collected during navigation of the Portal, or provided through the completion of any form, as well as data derived from the commercial relationship and/or delivery of purchased products, in the automated personal data file referred to in the first section. During the data collection process, the User will be informed whether providing such data is mandatory or optional for the delivery of the Products, except for placing orders, in which case abril et nature hereby informs the User that providing such data will not be considered optional, and therefore, it will be necessary to include the data relating to identity and address for the formalization and conclusion of the sale.
4.3 The User may exercise, with respect to the data collected as described in the preceding section, the rights recognized in Organic Law 15/1999, and in particular the rights of access, rectification, cancellation, and objection, if applicable, as well as the right to withdraw consent for the transfer of their data. The rights referred to in the preceding paragraph may be exercised by the User by means of a signed written request addressed to the following address: abril et nature, Customer Service Department, Calle Palautordera, 26 - 08401, Granollers, Barcelona, or by sending an email to shop@abriletnature.es or by telephone at +34 93 540 21 85.
4.4 abril et nature undertakes, in the use of the data included in the file, to respect its confidentiality and to use it in accordance with the purpose of the file, as well as to comply with its obligation to keep it safe and to adopt all measures to prevent alteration, loss, unauthorized processing or access, in accordance with the provisions of the Regulation of Security Measures of automated files containing personal data, approved by Royal Decree 994/1999, of July 11.
V. Intellectual and industrial property. Hyperlinks
5.1 All content displayed on the Portal, and in particular, designs, texts, graphics, logos, icons, buttons, software, trade names, trademarks, industrial designs or any other signs susceptible to industrial and commercial use, are subject to intellectual and industrial property rights of abril et nature or of third-party owners who have duly authorized their inclusion on the Portal.
5.2 Under no circumstances shall it be understood that any license is granted or that there is any waiver, transfer, assignment, total or partial of said rights, nor shall any right be conferred, and in particular, the right to alter, exploit, reproduce, distribute or publicly communicate said content without the prior express authorization of abril et nature or the corresponding owners.
5.3 abril et nature authorizes the partial reproduction of its content on third-party websites under the following conditions:
1ª - The mention of the partial content will always be accompanied by a hyperlink to the URL where the total and original content mentioned is located, within the abril et nature website.
2ª - Along with the partial reproduction and hyperlink, the authorship of the same will be indicated, stating it as abril et nature or abriletnature.es.
3ª - The use of these partial reproductions MAY NEVER BE USED FOR ONE'S OWN COMMERCIAL PROFIT without the express authorization of abril et nature.
abril et nature will pursue and act against any reproduction of its content that does not comply with these conditions, and for this purpose may use all legally existing electronic and digital means, such as digital watermarks or IP signals.
VI. abril et nature's responsibility
6.1 abril et nature will only be liable for damages that the User may suffer as a result of using the Portal when such damages are attributable to its own willful misconduct. The User acknowledges and accepts that the use of the Portal, as well as the purchase of products, is carried out at their own risk and under their sole responsibility.
6.2 abril et nature is not responsible for any damages that may arise from, including but not limited to, the following.
- Inferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational functioning of this electronic system or in the computer devices and equipment of the Users, motivated by causes beyond abril et nature, that prevent or delay the making of orders or browsing through the portal;
- Delays or interruptions in use caused by deficiencies or overloads of the Internet or other electronic systems;
- That may be caused by third parties through illegitimate intrusions outside the control of the Portal and that are not attributable to abril et nature.
- The impossibility of providing the Service or allowing access due to causes not attributable to abril et nature, due to the User, third parties, or to cases of force majeure.
6.3 abril et nature does not generally control the use that Users make of the Service.
In particular, abril et nature does not guarantee under any circumstances that Users will use the Service in accordance with the law, these General Conditions, generally accepted morality and good customs and public order, nor that they will do so diligently and prudently.
VII. User obligations
7.1 In general, the User is obliged to comply with these General Conditions, as well as to comply with the special warnings or instructions for use contained therein or on the Portal and to always act in accordance with the law, good morals and the requirements of good faith, employing the diligence appropriate to the nature of the service he enjoys, refraining from using the Portal in any way that may impede, damage or deteriorate the normal operation of the same, the goods or rights of abril et nature, its suppliers, the rest of the Users or in general of any third party.
7.2 Specifically, and without this implying any restriction to the obligation assumed by the User in general in accordance with the previous section, the User agrees, in the use of the Portal, as well as in the acquisition of the Products to:
- In the event of making a purchase, the User is obliged to truthfully provide the requested data.
- Do not introduce, store or disseminate on or from the Portal any information or material that is defamatory, libelous, obscene, threatening, xenophobic, incites violence or discrimination based on race, sex, ideology, religion or that in any way violates the form, public order, fundamental rights, public freedoms, honor, privacy or image of third parties and in general current regulations.
- Do not introduce, store or disseminate through the Portal any computer program, data, virus, code, hardware or telecommunications equipment or any other electronic or physical instrument or device that may cause damage to the Portal, any of the Services, or any of the equipment, systems or networks of abril et nature, any User, abril et nature's suppliers or any third party in general, or that may otherwise cause any type of alteration or prevent their normal operation.
- Do not carry out advertising, promotional or commercial exploitation activities through the Portal, do not use the content and in particular the information obtained through the Portal to send advertising, send messages for direct sales purposes or for any other commercial purpose, nor to collect or store personal data of third parties.
- Do not use false identities, nor impersonate others when using the Portal or when using or acquiring any of the Products, including the use of third-party passwords or access codes or in any other way.
- Do not destroy, alter, disable or damage the data, information, programs or electronic documents of abril et nature, its suppliers or third parties.
- Do not introduce, store or disseminate through the Portal any content that infringes intellectual property rights, industrial property rights or trade secrets of third parties, or in general any content that you do not have the right to make available to third parties in accordance with the law.
VIII. Communications
For the purposes of these General Terms and Conditions, and for any communication that may be necessary between abril et nature and the User, they must contact the Customer Service Department by email (sending a message to shop@abriletnature.es), by telephone at 93 540 21 85 or by written communication addressed to the Customer Service Department of abril et nature, Calle Palautordera, 26 - 08401, Granollers, Barcelona.
abril et nature's communications to the User will be made in accordance with the data provided by the User when registering on the Portal.
IX. Applicable law. Arbitration
9.1 This contract shall be governed by Spanish law, which shall apply to matters not covered by this contract regarding interpretation, validity and execution.
9.2 In the event of any type of disagreement or claim between the parties in relation to the fulfillment or content of these General Conditions, the parties will negotiate in good faith to try to resolve such disagreement or claim within a maximum period of one (1) month from the date on which either of them formally notifies the other that the disagreement has arisen or notifies the claim.
